The legality of ROMs

I’ve been following up on my post from Jak and Daxter Buddy Icons from a few days ago that had a blurb about the legality of ROMs and have done a little research.

I’ve found several sites that say pretty much that all their ROMs are legal no matter what ,but there are alot more who are the almost opposite.

From those sites ROMs are only legal IF you own the game in real life such as a Super Mario ROM would be completely legal IF you owned it for the SNES.

But if you’ve never bought the game it is ILLEGAL and yes, it is ok to have bought the game a long time ago and have sold it to like upgrade to a newer system ,because as long as you’ve bought that game at one time or another used or new it is perfectly legal ,which makes it kinda like music and movies. “However, as soon as you sell the game you give up your right to own the ROM.”(Thank you nanousr for correcting me there.)

But, if you’ve never owned the game it’s illegal and that’s that.

This is false. If you own the game that you have a ROM of, it is mostly legal, however, as soon as you sell the game you give up your right to it.

ALSO, Owning the ROM for one DAY IS FALSE and, NINTENDO Do not Allow ROM Backups (Owning the Rom and the Game) SO Downloading a Nintendo Related GAME is illegal.

Is somehow possible to use ROMS ,legally, if the game sytem you are looking for is out of production and you can’t find games for it. I need games for older system older systems like N64, Super Nintendo, and Atari.
Also, downloading a Nintendo related Game would be all right as long as you have the orginal game ,right?
If it is illegal please provide a place that you may know of where to get some of these games if there are any.
